On 13 November 2023, Law no. 342/2023 on supplementing Articles 10 and 31 of the Government Emergency Ordinance no. 158/2005 on social health insurance leave and allowances was published with the Official Gazette. As a result of this amendment, women who are self-employed will be able to continue their activity during the maternity leave, receiving at the same time the childcare allowance.
Given the fact that an interruption of the professional activity during the maternity leave can irreparably affect the business conducted, we consider this legislative amendment laudable, also for its role to encourage the birth rate.
